Dry Hire Terms and Conditions – Revised January 2018
1. GENERAL HIRE INFORMATION
1.1 Total hire amount (including GST) is due prior to or on pick up/delivery of hire items. Should items not be fully paid for by the scheduled delivery or pick up date SAS Events has the right to refuse hire of items included in this invoice on the date’s items unless alternative arrangements have been agreed upon in writing.
1.2 A 50% non-refundable deposit is required to hold the booking. Bookings are not confirmed until a deposit has been received or alternative arrangements have been agreed upon in writing.
1.3 If a booking which has been paid in full prior to the event is cancelled more than 2 weeks prior to the event all paid monies minus the 50% deposit will be refunded to the client. If the booking is paid in full and cancelled less than 2 weeks prior to the scheduled delivery or pick up date no refund of any monies paid will be given.
1.4 The Client is responsible for the collection and return of the hire items, except where prior alternate arrangements are made with SAS Events.
1.5 SAS Events has discretion as to the mode of delivery and the Client must, at all times, bear the cost of delivery as quoted, unless otherwise agreed in writing by SAS Events. With each Delivery, the Hire Agreement will itemise the Equipment delivered.
1.6 The Hire Agreement is deemed to be conclusive evidence that the listed hire items were delivered or picked up in good working order.
1.7 Hire pick-ups and drop offs must be made during regular Showroom open hours. The Showroom is open from 8am to 3pm Monday to Friday. Additional costs apply if delivery and pick up is required outside these times.
1.8 All hires once delivered or picked up are final. No refunds will be given in the event that hire products cannot be utilised due to weather or personal reasons of the Client, such as, but not limited to, injury or illness.
1.9 All hires are due by 3pm on the return date. A charge will be assessed each day that the equipment is late. If the equipment is not returned within one week of the return date the Client will be charged the total amount of the additional daily fees for one week and the replacement cost of the products.
1.10 All hire items must be returned to the SAS Events Showroom and checked in by a SAS Events employee. If the equipment is not properly checked in, the Client will be charged a $10.00 fee for each item.
1.11 All hire items will go through a brief initial inspection upon return. Once returned, hire products are given a final inspection before it is available to hire again. Clients will be notified as soon as possible if there are any item issues discovered during the initial and/or final inspections.
1.12 All late hire items will be charged as follows: Additional Day Fee = (Daily rental Rate) x (Number of Days Late).
1.13 When returning hire products, the Client is expected to ensure all parts are present on return.
2.CLIENTS USE OF HIRE ITEMS
The Client must:
2.1 Not use the hire item/s in or near water or areas of heavy construction;
2.2 Not transport the hire item/s out of Victoria Australia, without the prior written consent of SAS Events;
2.3 Not use the hire items in a way that can be deemed hazardous;
2.4 Advise SAS Events of any fault in the hire item/s, within 24 hours of the Clients discovery of such fault;
2.5 Not use the hire item/s for any other purpose than what they are specified for;
2.6 Not modify or disassemble the hire item/s unless given written permission;
2.7 Take all reasonable precautions to avoid loss or damage to the hire item/s during the hire period;
2.8 Not use the hire item/s where it could be affected by climactic conditions including but not limited to excessive exposure to sunlight, rain, heat, cold, corrosion, contamination, or pollution;
2.9 Expose the hire item/s to excessive dust or sand;
2.10 In the case of self-assembly, ensure that the hire items are used in a proper manner by persons with the necessary experience and familiarity with the hire item/s.
4. LOSS AND THEFT
4.1 If the hire item/s mysteriously disappears or is stolen from the Client where the Client has not taken reasonable steps to insure the hire item/s safety, the Client is liable for and agrees to compensate SAS Events for the greater of replacement cost (without deduction for depreciation) or the insurance value.
4.2 The Client will not attempt to repair any damage to the hire item/s themselves.
5.BREACH OF HIRE AGREEMENT BY THE CLIENT
5.1 If the Client breaches any clause whatsoever of this Agreement, or becomes bankrupt, insolvent or ceases business, then SAS Events shall be entitled to
a) Terminate this Contract, and/or
b) Sue for recovery of all monies owing by the Customer, and/or
c) Repossess the Equipment (and is authorised to enter any premises where the hire item/s are located to do so.
5.2 In the case that an invoice is outstanding after 60 days and the original booking is made and organised via a third party but addressed to different client, the individual/company who initially organised the booking is responsible for paying any monies outstanding.
